Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Fade GPT (“FadeGPT”, “we”, “us”, or “our”), including our website, desktop applications, and related services (the “Service”). By downloading, installing, or using Fade GPT, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract to use Fade GPT. By using the Service, you represent that you meet these requirements.

2. Free Early Access

Fade GPT is offered free of charge to the first 5,000 users as part of an early-access program. Free access may include full product features while spots remain. We may:

• Limit the number of free accounts or downloads
• Change, pause, or end the free program with reasonable notice where practical
• Introduce paid plans after the early-access period for new users

Early-access users may retain free access under conditions we communicate at the time of any plan change. Free access is personal, non-transferable, and may not be resold.

3. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Fade GPT desktop application on devices you own or control, solely for your personal, lawful use.

You may not:

• Copy, modify, reverse engineer, or create derivative works of the Service (except as allowed by law)
• Rent, lease, sell, sublicense, or redistribute the software
• Bypass security, usage limits, or access controls
• Use the Service to build a competing product using our proprietary materials
• Remove proprietary notices from the software or documentation

4. Acceptable Use

You agree not to use Fade GPT to:

• Violate any applicable law, regulation, or third-party rights
• Interfere with or disrupt the Service or other users
• Upload malware or attempt unauthorized access to systems
• Harass, abuse, or harm others
• Misrepresent the Service’s output as solely your unaided work where disclosure is required by an employer, school, or platform policy

You are solely responsible for how you use Fade GPT during interviews, assessments, and professional evaluations, including compliance with employer, platform, and academic rules.

5. AI Output & No Guarantees

Fade GPT generates suggestions using AI. Outputs may be incomplete, inaccurate, or inappropriate for your situation. You must review and verify all answers before relying on them. We do not guarantee interview outcomes, job offers, or exam results.

The Service is provided as a productivity aid, not as professional legal, career, or technical advice.

6. Accounts & Security

If an account is required, you are responsible for safeguarding credentials and for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.

7. Intellectual Property

Fade GPT, including software, branding, UI, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

You retain ownership of content you submit. You grant us a worldwide, royalty-free license to process that content solely to operate and improve the Service as described in our Privacy Policy.

8. Third-Party Services

The Service may rely on third-party platforms (e.g., cloud hosting or AI providers). We are not responsible for third-party terms, outages, or policies outside our control.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR UNDETECTABLE IN EVERY ENVIRONMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fade GPT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50 IF YOU USE THE FREE EARLY-ACCESS VERSION.

11. Indemnification

You agree to indemnify and hold harmless Fade GPT and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms or applicable laws.

12. Termination

You may stop using Fade GPT at any time by uninstalling the app and discontinuing use of the website. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

13. Changes to the Terms

We may update these Terms periodically. We will revise the “Last updated” date and, for material changes, may provide additional notice. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Fade GPT operates, without regard to conflict-of-law principles, except where mandatory local consumer laws apply. Courts in that jurisdiction shall have exclusive venue, unless applicable law provides otherwise.
